Terms of Service

These Terms of Service ("Terms") govern your access to and use of MenuForge (the "Service"), operated by [LEGAL ENTITY NAME], a company registered in the Sultanate of Oman (commercial registration no. [CR NUMBER]) ("MenuForge", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

MenuForge is a software-as-a-service platform that lets restaurant owners create and operate a digital menu and online ordering storefront. We provide the software only; the restaurant remains solely responsible for its menu content, prices, food, fulfilment, and customer service.

2. Eligibility and accounts

You must be at least 18 years old and authorised to act for the business you register. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use.

3. Subscription plans and billing

The Service is offered under tiered plans (Basic, Plus, and Premium) priced in Omani Rials (OMR). Fees, features, and limits for each plan are shown on the pricing page. Unless stated otherwise:

  • Subscriptions renew automatically for successive periods until cancelled.
  • Fees are billed in advance and are non-refundable except as set out in our Refund Policy.
  • We may change plan pricing or features with prior notice; changes take effect at your next renewal.
  • Early-access or free accounts may be offered at our discretion and may be modified or withdrawn at any time.

4. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose or in breach of Omani law; (b) upload content that is illegal, infringing, deceptive, or harmful; (c) attempt to gain unauthorised access to the Service, other accounts, or our infrastructure; (d) probe, scan, or test the vulnerability of the Service without our written consent; (e) resell or sublicense the Service without authorisation; or (f) misrepresent prices, availability, or the nature of goods sold through your storefront.

5. Your content and data

You retain ownership of the content you upload (menu items, images, restaurant details, and order data). You grant us a limited licence to host, process, and display that content solely to operate the Service for you. You are responsible for ensuring you have the rights to all content you upload and that it is accurate and lawful.

6. Intellectual property

The Service, including its software, design, and branding, is owned by MenuForge and protected by applicable law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.

7. Third-party services

The Service may rely on third-party providers (for example, payment processing via Thawani and customer messaging via WhatsApp). Your use of those services is subject to their own terms, and we are not responsible for their availability or actions.

8. Availability and disclaimer

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, MenuForge shall not be liable for indirect, incidental, or consequential losses, loss of profits, revenue, data, or goodwill. Our total liability for any claim shall not exceed the fees you paid for the Service in the three (3) months preceding the claim.

10. Suspension and termination

You may cancel at any time as described in the Refund Policy. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; we may delete your data after a reasonable retention period.

11. Governing law

These Terms are governed by the laws of the Sultanate of Oman. Disputes shall be subject to the competent courts of Oman.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "last updated" date and, where appropriate, notify you. Continued use after changes means you accept them.
